Privacy policy and personal data

  • 1.1 The Administrator may collect following information regarding the User (including personally identifiable information) in connection with the use of the Services:
    • 1.1.1 any information provided by the User during registration of the Account (particularly any information listed in section 5 of terms of service)
    • 1.1.2 any information made available by the User in his/her Facebook account – in accordance with privacy settings chosen by the User in Facebook (particularly: email address, first name, last name, nickname, gender, list of friends )
    • 1.1.3 any information made available by the User during use of the Services, particularly any comments, reviews, ratings, messages, photos
    • 1.1.4 GPS location of User’s mobile device – as provided by the mobile device used by the User; GPS location may be disabled by the User directly on the mobile device used by the User
    • 1.1.5 information about connections and contacts between the Users
    • 1.1.6 information about the Trucker’s routes
    • 1.1.7 information about vehicles driven by the Users
    • 1.1.8 information about cargo transported by the Users
    • 1.1.9 information about preferences of the Users (regarding particularly choice of places, goods and services reviewed, marked or otherwise mentioned by the User within or through the Services)
    • 1.1.10 information about search terms used by the User in the Services
    • 1.1.11 information about friends requested by the User to join the Services (particularly first name, last name, e-mail address)
  • 1.2 The User may choose at any point to be visible or hidden for other Users within the App.
  • 1.3 The Information may be collected directly from the User or automatically, during registration of the Account or use of the Services.
  • 1.4 The Administrator uses cookies and similar technologies (such as web beacons). Cookies are small data files sent by the website and stored in the User’s web browser in order to help the Administrator develop the Services. The cookies alone don’t allow User’s identification. By using the Services without prior settings change of the software used by the User, the User agrees to accept cookies by used software (particularly web browser used by the User). Guidelines for blocking cookies in most popular Internet browsers may be found under following links: Mozilla Firefox / Internet Explorer / Opera / Google Chrome. The Administrator is committed to offer the Users a choice regarding provision of their personal data. The User agrees however that refusal of provision of required data or blocking of cookies may disallow provision of the Services or cause improper functioning of the Services.
  • 1.5 The Administrator may use both persistent cookies and session cookies. Persistent cookies remain after the User closes Internet browser in his/her electronic device and may be used during subsequent visits to the Services. Session cookies disappear after the User closes Internet browser in his/her electronic device.
  • 1.6 The cookies enable tracking of following information:
    • 1.6.1 information about User’s activity on the Services, regarding particularly: time and duration of use of the Services, visited web addresses, functions used within the Services
    • 1.6.2 information about software (particularly Internet browser and operating system) and electronic device used by the User
    • 1.6.3 information about location of the User
    • 1.6.4 information about Internet addresses visited by the User directly before and after use of the Services
    • 1.6.5 information about Internet connection provider
    • 1.6.6 information about Internet connection speed and type
    • 1.6.7 information stored on the mobile device of the User which may include photos, videos, personal contacts and contact book addresses
    • 1.6.8 unique mobile device identifier assigned by the manufacturer of the mobile device used by the User
    • 1.6.9 MAC address of the electronic equipment used by the User
    • 1.6.10 User’s preferences regarding chosen language or time zone
    • 1.6.11 information about online or offline status of the User in the App
  • 1.7 The cookies, similar technologies and collected Information are used by the Administrator for following purposes:
    • 1.7.1 to remember User’s choices within the Services and enable faster and more comfortable use of the Services
    • 1.7.2 to improve the Services and personalize the content provided within the Services adequately to User’s location, choices and preferences
    • 1.7.3 to diagnose and analyze any technical problems within the Services
    • 1.7.4 to increase the security of the Services
    • 1.7.5 to keep the User logged in to the Services
    • 1.7.6 to process any queries placed by the User
    • 1.7.7 to generate reports about the use of the Services by the Users
    • 1.7.8 to provide the User with notices regarding the Account or the Services
    • 1.7.9 to display ads which are adequate to User’s preferences
    • 1.7.10 to generate reports about User’s routes and provide them to Trucking company linked with the User;
    • 1.7.11 to track routes driven by the Trucker, any problems encountered by the Trucker, status of the cargo transported by the Trucker and provide these information to Trucking company linked with the User
    • 1.7.12 to allow and maintain proper use and functionality of the Services
    • 1.7.13 to generate, analyze and provide the providers of services included in the App (particularly owners of any places listed in pt. 4.5.2 of terms of service) the anonymized statistics including, particularly: the age, sex and place of residency of Users reviewing services offered by service providers
    • 1.7.14 perform any obligations and enforce any rights arising from the Agreement
    • 1.7.15 any other purposes agreed with the User
  • 1.8 Any information collected by the Administrator may be disclosed to:
    • 1.8.1 other Users – when information are made available to them by the User (particularly by contacting other Users or placing information in publicly accessible area of the Services)
    • 1.8.2 employees and contractors of the Administrator involved in provision of Services (such as IT experts, software developers, hosting providers, payment processors)
    • 1.8.3 any subsidiaries, affiliates, buyers or successors of the Administrator (particularly in case of any merger, acquisition and transformation of the Administrator)
    • 1.8.4 to third parties advertising their services within the Services – in regard to the Users who consented on receiving such advertisements
    • 1.8.5 any courts, administrative bodies and law enforcement agencies – in accordance with applicable laws
    • 1.8.6 third parties who filed any claims against the Administrator, its affiliates, owners or officers in regard to the content placed by the User within the Services or any violations of the Agreement by the User
  • 1.9 The Administrator may use Google Analytics or other web analytics services offered by third parties which allow collection of anonymous data regarding the use of the Services by the User, particularly information listed in pt 1.6. above collected for purposes listed in pt. 1.8 above. Such information may be collected directly by or disclosed to web analytics service providers.
  • 1.10 Purchase of the subscription to the Platform or any other services offered within or through the App may require information regarding credit card, debit card or bank account of the User. By submitting such information the User reveals such information to pStripe and its affiliates in accordance with Stripe privacy policy available under following link: https://stripe.com/us/privacy.
  • 1.11 The User acknowledges and agrees that use of social media features (such as Facebook like button) within the Services may cause collection and publication of information regarding the User by social media provider.
  • 1.12 Third parties services linked with the Services (such as Facebook, Google Maps, Stripe online payment services) may use their own cookies and similar technologies – respectively to their own privacy policies. Privacy policy of Facebook, Inc. (owner of www.facebook.com service) may be checked at https://www.facebook.com/about/privacy, privacy policy of Google, Inc. (owner of Google services) may be checked at https://www.google.com/policies/privacy/ and privacy policy of Stripe, Inc. (owner of www.stripe.com service) may be checked at https://stripe.com/us/privacy.
  • 1.13 Any data collected by the Administrator will be stored on Google Cloud Datastore and/or Google Cloud SQL servers. Information regarding payments for purchased subscriptions will only be collected and stored by Stripe and its affiliates in accordance with its privacy policy.
  • 1.14 The Administrator reserves the right to anonymize any information collected from the User. Anonymized information (non-personally identifiable information) are not restricted by provisions of this section of the Agreement and may be used and disclosed to third parties without limitation.
  • 1.15 The User may disallow receipt of any messages regarding any services (save the Services) offered by the Administrator or third parties by checking the relevant box in his Account settings.
  • 1.16 The User may contact the Administrator in order to review, change or delete User’s personal data collected by the Administrator via an e-mail message sent from his/her contact e-mail address linked with his/her Account to the Administrator’s contact e-mail address: contact@truckersky.us. Deletion of some personal data may disallow provision of the Services. The Administrator reserves the right to keep the information required by applicable laws, information required to enforce any rights arising from the Agreement, to prove proper provision of the Services or to report or document any crime, tort or abuse committed by the User in connection with use of the Services.
  • 1.17 The Services are intended for use within the United States of America and hosted in the United States of America. If the User accesses the Services from other countries, he/she accepts that his/her personal data will be transferred to the United States of America and may be transferred to other countries in connection with storage and processing of data and provision of Services.
  • 1.18 The Administrator undertakes appropriate technical, organizational and physical means to safeguard any data collected from the User and prevent unauthorized access to such data. However, no method of storage of electronic data and transmission of data via Internet or mobile device is fully secure and cannot be guaranteed by the Administrator.
